7. International Transfers

Your data may be transferred to and processed in Canada (by POLARIS MONEY SERVICES INC.) and other countries. Such transfers are governed by appropriate safeguards including standard contractual clauses.

8. Data Retention

We retain account and transaction records for a minimum of five years after account closure to comply with AML regulations. Identity verification records are retained for the period required by applicable law. You may request deletion of non-essential data by contacting privacy@kryptelo.com.

9. Your Rights

1. Agreement to Terms

By accessing kryptelo.com, creating an account, or completing any cryptocurrency purchase, you confirm you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not use our services. These Terms constitute the entire agreement between you and Kaldex System OÜ ("Kryptelo", "we", "us", "our").

2. Eligibility

You must be at least 18 years old and legally permitted to enter binding contracts in your jurisdiction. You must not be a resident of a country subject to FINTRAC or FATF blacklisting or any applicable sanctions regime. By registering, you represent and warrant compliance with these requirements. We reserve the right to request proof of identity and eligibility at any time.

3. Nature of Service

Kryptelo provides a fiat-to-cryptocurrency conversion and dispatch service. We are not a cryptocurrency exchange, broker, investment adviser, or financial institution offering investment products. Purchasing cryptocurrency through Kryptelo does not constitute an investment and is not covered by any deposit guarantee scheme. All crypto purchases are final and dispatched to the wallet address you provide.

4. Cryptocurrency Exchange Services

Our cryptocurrency exchange services are provided through our principal licensed entity, POLARIS MONEY SERVICES INC., regulated by FINTRAC (Reg. No. C10001253). By using our services, you consent to the exchange, AML screening, and related procedures conducted by or on behalf of POLARIS MONEY SERVICES INC. in accordance with Canadian financial regulations.

5. KYC and Identity Verification

We are required by law to verify the identity of users above certain transaction thresholds. By registering and transacting, you agree to provide accurate identity documentation upon request, including government-issued photo ID and proof of address. Failure to provide required documentation will result in suspension or cancellation of your order and potential account termination. You represent that all funds used for purchases originate from legitimate sources.

6. Purchase Orders

Purchase orders are accepted at the exchange rate displayed at the time of submission. All prices are indicative and may vary slightly at settlement due to market movements. Confirmed orders are binding. Cryptocurrency is dispatched to the wallet address you provide; we accept no liability for errors in the wallet address you submit. Delivery typically occurs within 30 minutes of payment confirmation.

7. Payment

We accept Visa, Mastercard, and Maestro debit and credit cards. Card payments are processed by our PCI-DSS compliant payment partner. We reserve the right to decline any transaction at our discretion for security or compliance reasons. By paying, you confirm that you are the authorised holder of the card used.

8. Risk Warning

Cryptocurrency markets are highly volatile. The value of any cryptocurrency purchased through Kryptelo may fall significantly or to zero. Past performance is not indicative of future results. You should only purchase cryptocurrency with funds you can afford to lose entirely. Kryptelo does not provide investment, financial, tax, or legal advice. 9. Refunds and Cancellations

Cryptocurrency transactions are irreversible on the blockchain. Once an order is confirmed and dispatched, it cannot be recalled. Refund requests are governed by our Refund Policy. We will not provide refunds for losses arising from market price movements after dispatch. If a technical error on our part prevents dispatch, we will either re-send the order or refund the EUR amount paid at our discretion.

10. Prohibited Use

You must not use Kryptelo for: money laundering, terrorist financing, or any other illegal activity; purchasing crypto using stolen or unauthorised payment methods; evading applicable taxes or reporting obligations; circumventing AML or KYC controls; or any purpose that violates applicable law. Violation will result in immediate account termination, reporting to relevant authorities including FINTRAC, and forfeiture of any pending orders.

11. Limitation of Liability

To the maximum extent permitted by law, Kaldex System OÜ and POLARIS MONEY SERVICES INC. shall not be liable for: losses arising from cryptocurrency price movements; losses due to errors in your wallet address; service interruptions; or indirect, incidental, or consequential damages. Our total aggregate liability shall not exceed the total EUR amount paid by you in the 12 months preceding the relevant claim.

12. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be submitted to the jurisdiction of the Estonian courts. We will first attempt to resolve any dispute amicably; contact legal@kryptelo.com. Nothing in these Terms limits your rights as a consumer under applicable Estonian or EU consumer protection law.

13. Amendments

We may update these Terms at any time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the service constitutes acceptance of the revised Terms.

1. Overview

Kryptelo's cryptocurrency exchange services are provided through POLARIS MONEY SERVICES INC. (FINTRAC Reg. No. C10001253), incorporated in Canada and regulated by the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC). POLARIS MONEY SERVICES INC. operates a comprehensive Anti-Money Laundering and Counter-Terrorist Financing (AML/CTF) programme in accordance with Canada's Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and its associated Regulations.

3. Risk-Based Approach

We apply a risk-based approach (RBA) to AML/CTF compliance. The level of scrutiny applied to each user and transaction is proportionate to the assessed risk of money laundering or terrorist financing. Risk factors considered include transaction size, geography, user profile, source of funds, and transaction patterns. Higher-risk users and transactions are subject to enhanced due diligence (EDD).

4. Customer Due Diligence (CDD)

We conduct Customer Due Diligence on all users in accordance with FINTRAC requirements. Standard CDD includes: (a) collection and verification of full name, date of birth, and residential address; (b) verification of government-issued photo identification; (c) collection of information on the purpose and intended nature of the business relationship; and (d) screening against sanctions lists, politically exposed person (PEP) databases, and adverse media sources.

5. Enhanced Due Diligence (EDD)

Enhanced Due Diligence is applied to: high-risk customers including PEPs and their associates; transactions above FINTRAC reporting thresholds; customers in higher-risk jurisdictions; and transactions exhibiting unusual or suspicious patterns. EDD measures include requiring source of funds documentation, additional identity verification layers, senior management approval, and ongoing enhanced monitoring.

6. Transaction Monitoring

All transactions processed through Kryptelo are subject to automated and manual monitoring. We screen transactions against FINTRAC's indicators of suspicion and apply velocity and pattern-based controls. Transactions that trigger alerts are reviewed by our compliance team. Suspicious transactions are reported to FINTRAC via Suspicious Transaction Reports (STRs) as required by law.

7. Reporting Obligations

As a FINTRAC-regulated Money Services Business (MSB) and Virtual Currency Dealer, POLARIS MONEY SERVICES INC. files the following reports with FINTRAC as required: Suspicious Transaction Reports (STR); Large Virtual Currency Transaction Reports (LVCTR) for transactions of CAD 10,000 or more; Terrorist Property Reports (TPR); and Electronic Funds Transfer Reports (EFTR) where applicable.

8. Record Keeping

We maintain comprehensive records of all customer identification, transaction data, and compliance decisions for a minimum of five years as required by PCMLTFA. Records are stored securely and are available to FINTRAC upon lawful request.

9. Sanctions Screening

All customers and transactions are screened against Canadian sanctions lists administered by the Office of the Superintendent of Financial Institutions (OSFI), United Nations Security Council Consolidated List, and relevant international sanctions regimes. Any match results in immediate account suspension and reporting to relevant authorities.

10. No Tipping Off

In line with legal requirements, we are prohibited from disclosing to any customer or third party that a suspicious transaction report or other regulatory report has been filed in connection with their account or transactions.

1. Nature of Cryptocurrency Transactions

Cryptocurrency transactions are irreversible by their nature. Once crypto assets have been dispatched to the wallet address provided by you, it is not possible for us to reverse, cancel, or recall the transaction on the blockchain. You are solely responsible for ensuring the accuracy of the wallet address you submit with each order.

2. No Refunds for Market Movements

We do not offer refunds for losses arising from cryptocurrency price movements after your order has been confirmed and dispatched. The price volatility of crypto assets is an inherent risk that you accept when placing an order. The exchange rate shown at the time of order confirmation is the rate applied to your transaction.

3. Eligible Refund Conditions

A full refund of the EUR amount charged may be issued in the following circumstances:

• A technical error on our part prevented the cryptocurrency from being dispatched within 60 minutes of payment confirmation, provided you report this within 24 hours of the expected dispatch time.
• Your payment was processed but our systems experienced a verifiable failure that prevented order fulfilment.
• A duplicate charge was applied to your payment method due to a technical fault on our side.
• We were required to cancel your order due to a compliance or sanctions screening match (in this case a refund will be processed subject to applicable legal obligations).

4. Refund Process

To request a refund, contact support@kryptelo.com within 24 hours of the issue, providing your order reference number (KRP-XXXXXX), the email address registered on your account, a description of the issue, and any supporting evidence. Approved refunds will be returned to the original payment method within 5–10 business days. We reserve the right to request additional verification before processing any refund.

5. Chargebacks

Initiating an unauthorised chargeback with your card issuer for a completed and dispatched order is a breach of these Terms and constitutes potential fraud. We cooperate fully with card schemes and may provide evidence of delivery to contest fraudulent chargebacks. Users who initiate unjustified chargebacks will have their accounts permanently terminated.

6. AML Holds

Where a transaction is placed on hold pending AML/KYC verification and the verification is not satisfactorily completed, the EUR amount paid may be held for up to 30 days while compliance procedures are completed. In the event the transaction cannot be approved, the funds will be returned to the original payment method minus any applicable fees, subject to legal requirements.
